At least one progressive judicial advocacy group, Demand Justice, previously proposed Berner as a Supreme Court pick for President Joe Biden.
Carl Tobias, a University of Richmond law prof and judicial nominations expert, said this confirmation is notable a few reasons.
Beyond being a historic LGBTQ+ pick and one of very few judges who practiced employee-side labor law, Berner is further tilting this court's changing ideological balance.
“As recently as 2005 or so, [this court] was considered the most ideologically conservative appeals court in the nation,” Tobias told me.
