I once knew a fed judge (bougie, I know) who had it happen - another judge jailed the defendant and the trial rolled forward.
Nothing is Unconstitutional until a Judge says it is. Horrible things can happen between a Law passing and a Judge telling them to stuff it.
In a lot of cases, the Fear is the point. The people passing the law know it's going to get struck down.

Under Jewish law, a judge who condemns a guilty defendant to death is required to fast for a whole day. Imagine if judges still did this.
Surely it should be a rule that if one is to be a person who is responsible for setting laws they should also be familiar with the basic principles of law, such as “innocent until proven guilty” and not “guilty until proven innocent”.

At most, if someone is found guilty of a crime such as murder and it's motivated by hate, prosecutors can ask a judge to impose a harsher punishment at sentencing. But it's up to the judge to decide. (8/8)

I can judge him for failing to disclose enormous conflicts of interest, with multiple opportunities to correct the omission, and infer that he did so as a result of a guilty mind. I don't have to convict him of a felony to believe there is sufficient evidence he is corrupt.
